- Platform: All websites, APIs, and applications operated by LITL.
- AI Robots: Software agents (e.g., Scarlet, Ezelia, Edena) generating signals and execution scenarios.
- Account: Personal authenticated space providing access to the services.
- API Key: Authentication credentials provided by a third-party exchange for execution.
- Backtest: Execution simulation on historical data using modeled constraints and latency.
- Privilege Member: Customer benefiting from specific advantages according to the subscribed offer.
3. Purpose
These Terms govern the sale of subscriptions, access packs, and all services offered on the Platform, including AI Robots, analysis modules, backtests, and third-party integrations. LITL does not provide financial or investment advice of any kind.
4. Detailed Description of Services
- Access to AI Robots and their dashboards (scores, weights, decision metrics).
- Signal generation (entry/exit/cancel) based on user-selected parameters.
- Backtesting with reproducibility (timestamps, data sources, rolling windows, execution constraints).
- Connectors to compatible exchanges/brokers (e.g., OANDA / Bybit/Binance) using server-side encrypted API keys.
- Performance logs, CSV/JSON exports, private webhook for Privilege Members.
- Technical support and optional training depending on the offer.
5. Account, Authentication, and Access
Access to the Services requires an individual Account. The User agrees to keep their credentials confidential and remains responsible for all actions performed through their Account. LITL implements anti-fraud controls, connection anomaly detection, and access logging for security and audit purposes.
6. Plans, Pricing, and Taxation
Prices are expressed in USD and may change. Applicable amounts are those displayed at the time of subscription. Taxes or withholding potentially due in Paraguay or the User’s jurisdiction remain their responsibility. Payments are processed via a secure payment provider.
7. Billing, Renewal, and Failed Payments
Unless otherwise stated, recurring offers renew automatically for the same duration. In case of failed payment, LITL may retry collection, suspend access, and/or downgrade the Account until regularization. Invoices are issued electronically.
8. Withdrawal and Refunds
Unless mandatory Paraguayan law states otherwise, digital services delivered after immediate execution with explicit consent are not subject to withdrawal rights. Activated subscriptions are non-refundable, except in cases of substantial unavailability directly attributable to LITL.
9. User Obligations
- Configure API keys with minimum required permissions (read/trade, no withdrawal).
- Define risk parameters (leverage, size, SL/TP) under their sole responsibility.
- Comply with applicable laws, notably regarding taxation, currency exchange, and data export.
- Refrain from reverse engineering, overload (DoS), or unauthorized access.
10. Risk Warning
Trading carries significant risk of partial or total capital loss. Past performance, backtests, and simulations do not guarantee future results. The User acknowledges markets may be illiquid, volatile, subject to slippage, latency, disconnection, or execution failures from third-party providers.
11. Personal Data and Logs
LITL processes data required for account management, security, service execution, and support (legal basis: contractual execution and legitimate interest). Technical logs (access, AI decisions, errors) are retained for audit and improvement. No commercial transfer to third parties occurs without consent.
12. KYC/AML Compliance
LITL may request additional information for KYC and AML compliance. Failure to provide it or inconsistencies may result in temporary or permanent account suspension.
13. System and API Key Security
API keys are encrypted server-side and must never be shared in unsafe channels. LITL applies TLS/SSL, secret segmentation, role-based access control, and admin logging. The User remains responsible for the security of their local devices.
14. Availability, Maintenance, and Updates
LITL aims for reasonably high availability. Planned or unplanned interruptions may occur. Critical maintenance may be carried out without notice in urgent cases to preserve system and data integrity.
15. Limitation of Liability
To the extent permitted by law, LITL’s total liability, for any legal basis, is limited to the amount paid by the User over the past twelve (12) months for the relevant Service. Excluded are loss of profits, opportunity loss, indirect, special, consequential, or punitive damages.
16. Intellectual Property and License
Platform components (code, AI models, knowledge bases, interfaces, trademarks) are protected. A non-exclusive, non-transferable, revocable license is granted for the contract duration. Any unauthorized extraction, reproduction, or distribution is prohibited.
17. Prohibited Uses
- Mass scraping, port scanning, bypassing API limits, intentional overload.
- Unauthorized access sharing, resale of accounts, session rental.
- Use for illegal purposes, fraud, money laundering, or financing of prohibited activities.
18. Duration, Suspension, and Termination
The contract applies for the selected period. LITL may suspend or terminate access in cases of abuse, fraud, security breach, unpaid fees, or violation of Terms or legal obligations. The User may terminate their subscription in their client area at the end of the current period.
19. Force Majeure
Neither Party is liable for failures caused by irresistible, unforeseeable, and external events (disasters, wars, major Internet outages, administrative decisions, etc.).
20. Governing Law and Jurisdiction
These Terms are governed by Paraguayan law. Any dispute falls under the competent courts of Encarnación (Itapúa), without prejudice to mandatory public-policy rules.
21. Evidence and Electronic Signature
Logs, timestamps, electronic receipts, emails, and payment records constitute proof between the Parties. Online acceptance constitutes electronic signature and contractual commitment.
22. Amendments to the Terms
LITL may amend these Terms for legitimate reasons (security, compliance, improvement). Updated versions are published on the Platform and apply to renewals and new subscriptions.
